Eligibility for NHS continuing care depends on an assessment of needs – if your physical or a mental condition (for example Alzheimer’s and/or Dementia) means you or your relative require substantial nursing care - then you have passed the primary needs test. This applies to everyone -regardless of your financial situation.

However there are many people in nursing homes whose primary need is nursing but they are paying the bill themselves – either because they have been incorrectly assessed or no assessments have been undertaken - or because their health has deteriorated since the last assessment.

Those with assets lose out. If you had nothing to start with - no property or no savings - then the bill is picked up by your local Social Services. Our Continuing Care Team are happy to review all cases to see whether a claim can be made for reassessment and a refund – or perhaps an acknowledgement that fees should stop and the NHS will fund future care.

We operate a “no win – no fee” system. If successful, our costs will be paid out of the money refunded by the NHS. If we stop them charging you for future fees then we will bill you on a private client basis for work undertaken.
